Access to and use of the Site and related services (collectively, the “Services”) are made available to you in accordance with the following Terms of Service and any other rules and policies posted on the Site (collectively, the “Terms & Conditions” or “T&C”). By using the Services, such as browsing or placing orders on the Site, you are agreeing to all of the Terms of Service.

This T&C does not acknowledge any relationship between you and Houristo Watch & Jewellery Limited whether as a partnership, collaboration, employment, or otherwise. It does not entitle you to hold yourself as a representative of Houristo Watch & Jewellery Limited.

Houristo Watch & Jewellery Limited reserves the right to make changes to the Site or any part of the T&C at any time. Please visit this page from time to time to check for any updates or changes to any part of the T&C.

All software and content which is defined as, or includes, any text, audio or music, video, graphics, photographs, and images (the “Content“) are the intellectual property of Houristo Watch & Jewellery Limited and are protected by intellectual property and copyright laws and international treaty provisions.

The Site is for your personal and non-commercial use only. Any non-personal and/or commercial use of the Content is only permitted when expressly authorised by Houristo Watch & Jewellery Limited and/or its third party licensor. You may not distribute, reproduce, publish, sell or license any Content contained within the Site without prior consent or authorization of Houristo Watch & Jewellery Limited . Any such unauthorized actions may result in civil consequences or criminal penalties.

Houristo Watch & Jewellery Limited reserves the right to withdraw or amend any item of the Services without notice. We will not be liable if for any reason the Site is unavailable at any time and for any period.

SECTION 3- ELIGIBILITY TO PURCHASE

In order to place orders with us, you must meet our conditions of eligibility:

– Be in possession of a valid credit/debit card issued by a licensed bank acceptable to Houristo Watch & Jewellery Limited for payment;

– Providing personal and payment details that are warranted by you to be both valid and accurate such as email address, real name, phone number, billing information and other requested information as indicated on the Site.

In placing an order with us, you authorise Houristo Watch & Jewellery Limited to process a charge or charges on your credit / debit card account in the amount of the total purchase price of your order. You also expressly authorise us to use personal information provided by you to perform appropriate anti-fraud checks such as credit checks and also to, where necessary, transmit or obtain information about you to or from third parties including, but not limited to, credit reference or fraud-prevention agencies, which may keep a record of that information.

SECTION 4- PRODUCT DESCRIPTION

Houristo Watch & Jewellery Limited will endeavour to ensure that the Content and the product descriptions on the Site are as accurate and complete as possible. We however do not warrant that Content and product descriptions are accurate, complete, current or error-free and Houristo Watch & Jewellery Limited is not responsible for any failures caused whether human or technical in nature.

SECTION 5- PRODUCT VALUATION

Houristo Watch & Jewellery Limited provide a product appraisal service free of charge in the Site. All price appraisal by Houristo Watch & Jewellery Limited are for reference only and Houristo Watch & Jewellery Limited does not guarantee the truthfulness of the price appraised. Houristo Watch & Jewellery Limited shall not be liable for any errors or misrepresentations made and you shall hold Houristo Watch & Jewellery Limited harmless against any and all claims, actions, liabilities, damages, costs, expenses, losses arising from such misrepresentations.

SECTION 6- PRICING

Prices displayed on the Site are subject to change without notice and is not final. Please contact us by WhatsApp to confirm the price before making any purchase to ensure the price is accurate and up to date. Whilst we use our best endeavours to ensure that all prices appearing on the Site are accurate, we do not guarantee that they are error-free and reserve our right to rectify any errors. If we discover an error in the price of any products that you have ordered, we will inform you as soon as possible and offer you the option of reconfirming or cancelling your order. If we are unable to contact you, we will treat the order as cancelled.

Taxes and duties applicable to your order depend on the shipping country of your order:

SECTION 7- PAYMENT

We accept payments made by Visa, MasterCard, Wechat, AliPay, Bank Transfer or Pay at Shop (“Payment Processor“).

Your order will be pending receipt of your payment proof to us within 2 working days, otherwise your order will be subject to cancellation. Please send your payment slip and order number to us by email service@houristo.com. Once your payment is confirmed received, we shall process your order immediately for delivery.

If you have paid a deposit to place an order on our products, the balance of the payment shall be made within 30 days once the product is available at our store for pickup which we shall notify you. If payment is not made within 30 days, we reserve the full rights to cancel the order and any deposit paid by you in advance will be non-refundable.

By placing an order using one of the above credit/debit card/bank money transfer payment methods, you confirm that the payment account used is yours or that you have been authorised by the owner to use it. If your credit card issuer refuses to authorise payment to Houristo Watch & Jewellery Limited, we will not be liable for any delay or non-delivery.

Our Payment Processor provider meet’s the stringent international security standards set down by the payment card industry to make your shopping experience safe and secure. If you have registered an account on the Site and have decided to save your card details with Payment Processor, your details will be fully encrypted, solely used to process card transactions that you have initiated and securely stored on our Payment Processor system. In the absence of negligence on our part, we will not be liable for any loss you may suffer if any third party procures unauthorised access to any data you provide when using our Services.

SECTION 8- ACCEPTANCE OF ORDER

Content including without limitation product images, descriptions, pricing, stock availability, and sizing information on this Site constitutes our invitation to treat, not a binding offer.

Once you have entered your personal and payment details and placed your order, we will send you an email acknowledging the receipt of your order. This email is confirmation of receipt of your order and does not constitute an acceptance of your offer/order or any promise concerning your offer / order.

If your order can be accepted by us, the contract between you and Houristo Watch & Jewellery Limited shall be deemed concluded when we send you an email to confirm that the goods under your order have been shipped to you.

Only the goods listed in the confirmation email sent at the time of shipment are included in the contract concluded. All sales contracts are concluded in Hong Kong SAR and are written in English.

Houristo Watch & Jewellery Limited reserves its right not to accept an order for any reason in its sole discretion (including but not limited to any of the following reasons):

– The product you ordered is out of stock, or is withdrawn for failure to meet quality standards or due to the shipping restrictions applicable to any or all of the ordered items.

– We are unable to obtain authorisation for payment.

– You do not meet the eligibility criteria to purchase as set out in these Terms Of Service.

SECTION 11- LIABILITY

To the extent permitted by law, in no event shall Houristo Watch & Jewellery Limited, including their respective officers, directors, employees, representatives, subsidiaries, affiliates, distributors, suppliers, licensors, agents or others involved in creating, sponsoring, promoting, or otherwise making available the Platform and its contents (collectively the Covered Parties), be liable to any person or entity whatsoever for any direct, indirect, incidental, special, exemplary, compensatory, consequential, or punitive damages or any damages or losses whatsoever, including but not limited to (where relevant, caused by): (a) loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, inconvenience, stress, distress, loss of claim, business interruption, data or other intangible losses; (b) your inability to use, unauthorized use of, delay, performance or non-performance of the Platform and/or the Services; (c) unauthorized access to or tampering with your personal information or transmissions; (d) the provision or failure to provide any service in relation to the Products, Requests, Offers and/or Purchases; (e) errors or inaccuracies contained on the Platform or any information contained in the Articles and/or of the Products as made available on the Platform; (f) any transactions entered into through the Platform; (g) any property damages including damages to your computer or computer system caused by viruses or other harmful components, during or on account of access to or use of the Platform or any site to which it provides hyperlinks; (h) damages otherwise arising out of the use of the Platform, any use, delay or inability to use the Platform, or any information, products, or services obtained through the Platform; (i) any (personal) injury, death, property damage, or other damages attributable to the Products; and (j) any damages caused by a Force Majeure Event.

Some events may happen beyond our reasonable control, such as adverse weather. Under such conditions, Houristo Watch & Jewellery Limited will always do its best to aim at maintaining its Services but will not be responsible for failing to meet any obligations in this T&C.The limitations of liability shall apply regardless of the form of action, whether based on contract, tort, negligence, strict liability or otherwise, even if a Covered Party has been advised of the possibility of damages.

SECTION 12- INDEMNITY

At our request, you agree to compensate us fully and hold us, Houristo Watch & Jewellery Limited, including its officers, directors, agents, affiliates, licensors, and suppliers, harmless from and against all liabilities, claims, expenses, damages and losses, including legal fees.

SECTION 13- JURISDICTION AND GOVERNING LAW

These Terms & Conditions, together with all our policies and procedures, are governed by and construed in accordance with China law. The relevant courts of the China will have exclusive jurisdiction in the event of any dispute or claim associated with these Terms & Conditions.

SECTION 14- MISCELLANEOUS

Save as otherwise expressed in these Terms and Conditions, these Terms and Conditions supersede and replace any and all prior oral understandings between Houristo Watch & Jewellery Limited and you regarding the Platform and/or the Services. 

You may not assign or transfer these Terms and Conditions, by operation of law or otherwise, without Houristo Watch & Jewellery Limited prior written consent. Houristo Watch & Jewellery Limited may assign or transfer these Terms, at its sole discretion, without restriction. Subject to the foregoing, these Terms and Conditions will bind and inure to the benefit of you and Houristo Watch & Jewellery Limited, the successors, permitted assigns and legal representatives of you and Houristo Watch & Jewellery Limited respectively.

Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms and Conditions, will be in writing and given by Houristo Watch & Jewellery Limited via email transmitted. 

The failure of Houristo Watch & Jewellery Limited to enforce any rights or provisions of these Terms will not constitute a waiver of future enforcement of those rights or provisions. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorised representative of Houristo Watch & Jewellery Limited k. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies thereunder.  

The original English version of these terms and conditions may have been translated into other languages. In the event of a dispute about the contents or interpretation of these Terms or inconsistency or discrepancy between the English version and any other language version of these Terms, the English language version to the extent permitted by law shall apply, prevail and be conclusive. 

These Terms shall be deemed severable. In the event that any provisions are determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law and such determination shall not affect the validity and enforceability of any other remaining provisions. The severed provisions shall be replaced by provisions approximating as much as possible the original wording and intent.
